How Apex Heart & Vascular Care communicates with you via SMS/text message, the consent we require before sending, and how to manage or withdraw your preferences at any time.
What messages you may receive from us.
Apex Heart & Vascular Care uses text messaging for account notifications and care coordination — not marketing spam. Depending on your relationship with our practice, you may receive the following types of messages:
- Appointment confirmations & reminders. Confirmations after you book, reminders 24–48 hours before your visit, and rescheduling links if needed.
- Follow-up after your visit. Post-procedure check-ins, care instructions, and links to relevant patient resources.
- Responses to inquiries you submitted. If you filled out a form on our website, a Facebook or Google ad, or requested a callback, we may text you to confirm and schedule your appointment.
- Care coordination. Referrals, lab or imaging results ready to review, and prescription notifications.
- Service updates. Occasional notices about new office locations, hours, or important operational changes.
We do not send unsolicited marketing texts. We do not share, rent, or sell your phone number to third parties, ever.
How your consent was collected.
Under FCC and TCPA rules, we can only text you if you’ve given express consent. Your consent may have been provided through one or more of the following methods:
- Verbal opt-in at an Apex office. A staff member asked, “Do you give Apex Heart and Vascular permission to contact you through text messages to book this appointment?” and you said yes. This consent is documented in your patient file with the date, time, and staff member.
- Web or ad form submission. You submitted a form on apexheartandvascular.com, our landing pages, or a Facebook/Google ad and checked a consent checkbox agreeing to receive text messages.
- Callback request. You provided your phone number by phone or in person and specifically requested that our team contact you to schedule an appointment.
- Keyword reply. You replied to one of our texts with a keyword such as YES, JOIN, or START to confirm opt-in.
- Signed paper form. You completed and signed our patient intake or communication authorization form at a physical office.
You may request a copy of your consent record at any time by emailing marketing@apexheartandvascular.com with the phone number on file.

This language appears on every opt-in form we operate, is stated verbally at every point of collection, and is disclosed in this policy. If you believe you received a text without providing consent, please reply STOP immediately and email marketing@apexheartandvascular.com — we will investigate and confirm removal from all lists within 10 business days.
Frequency, costs, and what to expect.
Below is what you should expect once you’re on our list. We keep frequency low and every message purposeful.
Delivery is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages. If a message fails to reach you (poor signal, do-not-disturb, network issue), we will not resend it more than twice.
How to stop texts — and how to reach us.
Withdrawing consent is easy and takes effect immediately. Choose whichever method is fastest for you:
- Reply STOP to any text. This is the fastest. Your number is removed from all Apex text lists within seconds. You will receive one final confirmation message.
- Fill out the opt-out form below. Enter your phone number and submit. Removal is processed within 1 business day.
- Call us. Dial 973·916·0002 and ask to be removed from SMS communications.
- Email us. Write to marketing@apexheartandvascular.com with the subject line “Unsubscribe SMS” and include your phone number.
For help at any time, reply HELP to any Apex text message. You’ll receive our contact information and a link to this page. Opting out of texts does not affect your ability to receive care at Apex — we’ll simply reach you by phone, email, or patient portal instead.
Manage your preferences.
Use the forms below to add or remove your phone number from Apex text communications. Both are processed by our internal team — not automated — typically within 1 business day.
How we handle your data.
Your phone number and any personal information you provide is used exclusively for the delivery of care and related communications by Apex Heart & Vascular Care. It is stored in HIPAA-compliant systems and protected by industry-standard technical and administrative safeguards.
- We do not sell your data. Ever. Not to advertisers, not to data brokers, not to marketing partners.
- We do not share your number with third parties except our licensed SMS delivery vendor (Twilio, Inc.), which is contractually required to protect your information under HIPAA-aligned Business Associate terms.
- Text message content is transmitted securely via encrypted APIs. However, please note that SMS itself is not end-to-end encrypted at the carrier level; do not send us sensitive medical details by text.
- Retention: We retain your consent record and SMS logs for a minimum of 4 years as required by TCPA record-keeping rules, then purge them per our retention schedule.
